Immigration within EU borders

At this moment, the assignment of non EU employees from one EU country to another is subject to more or less the same immigration procedures as when the non EU employee comes from a non EU country. In this article, a new measurement in the Netherlands is discussed, which is to make immigration within EU borders easier.

Blue card

You may think that there is a permit for these kinds of situations; the EU Blue Card. Yes and no. The Blue Card arranges the admission and the residency in EU countries. However, a work permit per country is still required and sometimes it is rather difficult to obtain a work permit. Like in the Netherlands. One of the conditions for a work permit is that the company can prove that it has recruited in the Netherlands as well as in the entire EU and that this recruitment has been unsuccesful. Most companies don’t have the time for this; they just want to move forward.

This is the exact reason why we often advised our clients to use the highly skilled migrant procedure in most of these situations in the past years. To meet the conditions of a highly skilled migrant permit prove to be easier than those for a classical work permit in the Netherlands. However, this practice will probably change by the end of this year.

Non EU assignments in EU

Suppose your company wants to assign non EU employees from let’s say Italy to the Netherlands. Starting from 29 November 2016, a special application will be in place for the immigration within EU borders. Non EU managers and specialists coming from other EU countries will be able to reside and work in the Netherlands for maximally three years, trainees for maximally one year. 

We expect that the new procedure will be easier in use than the current practice.
